These General Terms and Conditions (hereinafter: GTC) form the basis of the accommodation service contract concluded between the Calm Resort Hertelend guesthouse (Address: H-7394 Magyarhertelend, Páfrány utca 13., NTAK registration number: EG23083684, (Operator: Press Komm Kft.) hereinafter: Guesthouse or Service Provider) and the Guest.
These GTC do not contain individual terms, but they do not exclude the possibility of special agreements with travel agents, organisers or on other terms appropriate to the given business.
The House Rules of Calm Resort Hertelend form part of the GTC; the Guest receives them by email when booking, and a printed copy is also available at the accommodation. The Guest is obliged to read, accept and comply with the House Rules.
A Guest is any natural or legal person who uses the accommodation services offered by the Service Provider. Where the conditions are met, the Service Provider and the Guest together become contracting parties (hereinafter: the Parties).
If a third party (hereinafter: Intermediary) acts on behalf of the Guest when the contract for the service is concluded, the provisions of the GTC also apply, with the proviso that the Service Provider is not obliged to examine whether the Intermediary is authorised to represent the Guest. If the Intermediary has no such authorisation, it is itself liable for fulfilling the obligations arising from the contract that are incumbent on the Guest.
The Contract is concluded exclusively on the basis of the Guest's online, written request for quotation and the confirmation sent online by the Service Provider. If the Service Provider's confirmation differs from the conditions specified in the request, or if the request does not cover all matters necessary for concluding the contract, the contract between the parties is concluded when the parties reach agreement in writing or by email on all essential matters, or on any matter considered essential by either party. The contract becomes effective when the Guest has paid the booking deposit – 25% of the total accommodation fee. If the deposit is not received by the deadline specified in the confirmation, the Service Provider is entitled to cancel the booking.
The RESnWEB booking request (submitted via the online booking system, by email or in writing) contains the Guest's name, address, email address and telephone number, the dates of the booking and of arrival, the room type, the length of stay, the number of nights and the services the Guest wishes to use. The Guest is obliged to specify all questions and conditions in full in the request. The request does not cover the payment terms for the service.
After the contract has been concluded, the Service Provider sends the Guest a confirmation of the ordered service. Upon conclusion of the contract, the Service Provider makes the ordered service available to the Guest from the day of arrival and provides it in accordance with the House Rules and the GTC.
The deposit payable on booking is 25% of the total accommodation fee. The remaining amount must be paid no later than on arrival, by bank card, bank transfer, SZÉP card or in cash on site. The Service Provider issues an invoice for the full amount.
The Guest must pay the accommodation fee to the Service Provider no later than on arrival. The accommodation fee includes the fee for the services ordered by the Guest under the contract, the use of bed linen and towels, and the costs of consumption and cleaning where these are charged to the Guest under the House Rules.
The Service Provider publishes a detailed description of its services and other charges on its website and also sends it to the Guest by email after the contract has been concluded.
Cancellation: the Guest may cancel the booking free of charge by notifying the Service Provider in writing no later than the 14th day before arrival. In this case, the full amount paid will be refunded. If the booking is cancelled within 13 days of arrival, the Service Provider will not refund the deposit paid, but the Guest may use it once for another date within 6 months of the cancellation, subject to availability.
Changes: the Guest may change their stay once, free of charge, up to the 7th day before arrival, subject to availability; any price difference resulting from the new period must be paid. No changes are possible from the 6th day before arrival.
No-show, early departure: if the Guest does not arrive and has not cancelled in advance, the Service Provider will not refund the amount paid. The fee for unused nights is not refunded in the event of early departure either.
The Service Provider is entitled to amend or cancel the contract if it is unable to fulfil it for the following reasons:
If the Service Provider amends or cancels the contract, it will notify the Guest immediately and refund any amount already paid by the Guest. The Service Provider has no further liability towards the Guest.
The Guest bears full financial liability towards the Service Provider for any damage caused at the accommodation and for any acts or omissions resulting from a breach of the Service Provider's rules or the provisions of the GTC. The Service Provider accepts no liability for any damage or loss arising from circumstances beyond its control, such as power cuts, water outages or interruptions to the internet service.
If the Guest has any complaint about the service, they must report it to the Service Provider immediately so that the Service Provider has the opportunity to resolve the problem.
The Service Provider processes the personal data provided by the Guest in accordance with the applicable data protection regulations. The Service Provider's privacy notice is available on its website.
Any amendment to these General Terms and Conditions is valid only by written agreement. The contractual relationship between the parties is governed exclusively by Hungarian law. The parties submit to the jurisdiction of the Hungarian courts for the settlement of any disputes.
The Guest accepts this document and considers it binding by paying the accommodation fee or by sending a request for quotation.
The Parties may accept the GTC in writing or electronically (by online booking or by email).
By their signature and/or by their request for quotation and confirmation sent by email or in writing, the parties declare that they have read, understood and accepted the General Terms and Conditions and consider them binding.
By accepting the General Terms and Conditions, the Guest consents to the Service Provider processing their personal data in accordance with the applicable data protection laws and the provisions of the GTC.
